Terms of Service

Welcome to TRACE. These Terms of Service (the "Terms") govern your use of the marketplace and related services operated by TRACE ("TRACE", "we", "us", or "our") at addtrace.com, including our concierge, Tracey, on text message, Instagram, and web chat (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service. By using the Service you represent that this is true.

The Service

TRACE is a presale marketplace: you can list a piece you intend to acquire, and other users can bid to buy it from you or to rent it from you. Bidding is auction-style — the highest accepted bid wins. Some features may be in limited release, offered by invitation, or changed or withdrawn as the Service evolves.

Accounts

You can create an account with an email address or phone number, or one can be created for you when you first transact with Tracey (for example, by texting her from your phone number). You are responsible for the accuracy of your account information and for everything that happens under your account. We may suspend or close accounts that violate these Terms.

Tracey and messaging

Tracey is an automated, AI-powered concierge. By messaging her — by SMS or iMessage, by Instagram direct message, or through the chat widget on our site — you consent to receive replies on that channel. Message and data rates may apply to text messages; reply STOP to stop receiving texts and HELP for help. Instagram conversations are also subject to Meta's own terms. Tracey's replies are generated automatically and may contain mistakes — confirm important details (prices, availability, dates) before relying on them.

Listings, bids, and transactions

• You may only list pieces you genuinely intend to acquire and are able to deliver (for a sale) or make available (for a rental).
• A bid is a real offer. If your bid is accepted or wins, you are expected to complete the transaction at the bid amount.
• Rentals must be returned in the condition received, by the agreed date.
• We may charge fees for the Service; any fees will be disclosed before you incur them.
• TRACE is a marketplace. Unless we say otherwise in writing, we are not a party to transactions between users and do not guarantee that any listing, bid, or transaction will complete.

Acceptable use

You agree not to misuse the Service, including by: listing counterfeit, stolen, or prohibited items; manipulating bids; harassing other users or attempting to take transactions off-platform to avoid fees; scraping, reverse-engineering, or overloading the Service; or using it for anything unlawful.

Content

You keep ownership of content you submit (listings, photos, messages) and grant TRACE a non-exclusive, worldwide, royalty-free license to host, display, and use it to operate and promote the Service. You are responsible for having the rights to what you post.

Third-party services

The Service is built on third-party platforms — including Meta (Instagram messaging), our text-messaging providers, and payment processors — whose own terms and availability we do not control. Features that depend on them may be interrupted by them.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (US $100) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Termination

You may stop using the Service at any time (see our data deletion instructions to remove your data). We may suspend or terminate access to the Service at any time for conduct that violates these Terms or harms the Service or its users.

Changes to these Terms

We may update these Terms from time to time. If a change is material we will give notice (for example, on the site or by message). Continuing to use the Service after a change takes effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
